Nestiko Terms & Conditions
1. Acceptance of Terms of Service: These Terms of Service (the “Terms”) define the terms and conditions through which the Nestiko software services (the “Service”) are provided by Nestiko Business Solutions Private Limited (the “Company”). By signing up for the Service, you (the “Customer”) agree to be bound by these Terms. IF YOU DO NOT AGREE TO THESE TERMS, THEN DO NOT USE THE SERVICE. 2. Use of Service: The Service is available only for use by customers who agree to and comply with these Terms. The Company may discontinue or suspend the Service, or change the specifications, services or elements of the Service, at any time at its discretion without any liability. 3. Limitation of Use: The Customer is not allowed to use the Service for any unlawful or unauthorized purpose. The Customer is liable for the access and use of the Service through its account. 4. Payment: The Service shall be provided on payment of applicable charges. The Customer agrees to make timely payments for the Service as per the payment terms agreed with the Company. The Company reserves the right to suspend the Service in case the payment is overdue. 5. Service Level Agreement and Service Warranty: The Company will provide the Service in accordance with the stated Service Level Agreement (SLA). The Company will ensure that the Service is performed in accordance with appropriate skill, care and quality services and that the Service will be of the highest standard. The Customer is entitled to receive service warranty in the form stated by the Company from time to time. 6. Data Security and Privacy: The Company is committed to protecting the privacy of the Customer’s data including personal information. The Company shall ensure that the Customer’s data is secure from unauthorized access and any loss of such data. The Company shall take all necessary measures to maintain the security and privacy of the Customer’s data. 7. Maintenance and Support: The Company may include limited maintenance and support services with the Service. The Company may provide such maintenance and support services from time to time in its discretion. 8. Warranty Disclaimers: THE COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SERVICE, ANY DATA OR PROGRAMMING THAT MAY BE PROVIDED BY THE COMPANY, OR ANY OTHER MATTER. 9. Limitation of Liability: IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 10. Termination: These Terms will remain in effect until terminated. The Company may terminate the Service and/or these Terms if the Customer fails to comply with these Terms, or for any other reason at its discretion. 11. Governing Law: These Terms shall be governed by and construed in accordance with the laws of India and any disputes arising out of or in relation to this contract shall be subject to the exclusive jurisdiction of the Indian Courts in Rajasthan only.
